Authority to Sell & Proof of Ownership Requirement
-As PRC-licensed Real Estate Brokers, we are required to strictly comply with the rules and directives of the Professional Regulatory Board of Real Estate Service (PRBRES) under the Professional Regulation Commission.
Under the PRBRES Memorandum dated June 19, 2019, licensed Real Estate Brokers are mandatorily required to secure the following before listing, advertising, or negotiating the sale of any real property:
A written Authority to Sell or Authority to Negotiate, duly signed by the registered owner or the authorized Attorney-in-Fact; and
Proof of ownership, such as a copy of the Transfer Certificate of Title (TCT) or Condominium Certificate of Title (CCT).
This requirement is imposed by regulation and is not discretionary.
The purpose of this requirement is to:
Verify that the property is being marketed with the consent of the registered owner
Prevent unauthorized, duplicate, or fraudulent listings
Ensure transparency and accountability in real estate transactions
Protect all parties involved—owners, buyers, and brokers
Marketing a property without the required written authority and proof of ownership may expose a licensed broker to administrative sanctions, including suspension or revocation of PRC license, after due process.
